WEDGEWELL-McDUFF LLC PRIVACY POLICY
This Privacy Policy applies to your use of the 4Par app (“App), any website we own or operate connected with the App and any related services (collectively, the “Services”) and describes how Wedgewell-McDuff LLC, an Oregon limited liability company (“Wedgewell-McDuff,” “we,” “us,” or “our”), collects, uses, and protects your personal information. When you submit personal information to us, whether through use of or access to the Services or otherwise, you are consenting to the collection, use, transfer, and disclosure of your personal information as described in this Privacy Policy. If you have questions about this Privacy Policy, please contact Wedgewell-McDuff using the contact information located at the end of this Privacy Policy.
1. Information We Collect.
When you submit information to us via your use of our Services or otherwise correspond with us, we receive and store that information, including personal information. “Personal Information” includes any information you provide to us that could reasonably be used to personally identify you, including the following types of Personal Information:
1.1. Information You Provide Directly to Us. If you choose to contact us via the App or directly, you may need to provide certain information, including contact information.
1.2. User Accounts. Some features of our App, and other services are only accessible if you create a user account. To create a user account, you may be required to have an account with a supported external single sign-on (SSO) identity providers (IDP) such as Facebook or Apple in order to use some of our Services. Where this is the case, the personal data we collect also depends on which IDP you choose to use, their privacy policy, and what your privacy settings with those services allow us to see when you use their services to access Wedgewell-McDuff Services.
1.3. Financial Information. Payments for our Services, including subscriptions to our App, are processed through the Google Play Store or iOS App Store. We never receive or store your financial information.
1.4. Technical Information.
a. Whether you are using our Services with or without a user account, we automatically receive and record certain information that your web browser provides, including information such as your web request, Internet Protocol (“IP”) address, browser type, browser language, referring/exit pages and URLs, platform type, domain names, type of device and operating system, pages, and information about your usage and interaction with our Services. In addition, we collect and use your device location information as you use our Services (and, if you elect to turn on background location tracking for participating Services, while you are not directly interacting with these Services), including how you move around and events that occur during gameplay. Our Services include location-based use whose core feature is to provide a gameplay experience tied to your real-world location, so we need to know where you are to operate these Services for you. We identify your location using a variety of technologies, including GPS, the WiFi points you are accessing the Service through and mobile/cell tower triangulation;
b. We also collect and use your in-game actions and achievements, as well as certain information about your mobile device (including device identifiers, device OS, model, configuration, settings and information about third party applications or software installed on your device), to operate the Services for you and to personalize your user experience.
2. How We Use Your Personal Information.
We use Personal Information as described in this Policy, including to provide the Services and to send you communications. We will also use your Personal Information for the purpose stated when we ask for such Personal Information.
2.1. Providing and Supporting our Site.
We may use your Personal Information to help diagnose problems with the Services, to make our app more compatible with the technology used by our users, to analyze statistical use patterns, and to otherwise improve our Services. For example, we may use your IP address, browser type, operating system, the web page you were visiting before accessing our Services, the pages of our Services which you browsed or the features you used, and the time spent on those pages or features, the links on our Services that you click on, device and advertising identifiers, age, as well as actions you take during use, your in-game user settings and preferences (including avatar characteristics) and your in-app purchases to learn about our users, and understand who is using our Services and how.
2.2. Communications.
We may use your Personal Information to provide you information about Wedgewell-McDuff and its products and Services that may be of interest to you, and where required by law, only if you have opted-in to receiving such information. We will never share your Personal Information with a third party for their own marketing or independent uses, except: (1) where you consent to such information sharing and (2) as described in this Privacy Policy.
If we use your Personal Information to send you marketing communications, we will provide you with an unsubscribe mechanism to opt-out of receiving future marketing communications, or you can contact us to request that we not send you marketing communications. If you request that we not contact you for marketing purposes (either by using the unsubscribe mechanism or contacting us), we reserve the right to contact you for non-marketing purposes relating to your use of our Services.
2.3. Social.
We may use your Personal Information to provide social features within our App so you can interact and play with other players, including storing your communications, content, and other information shared with those players, finding your friends and being found by them, including through imported contacts, and sharing your experience and achievements with your friends. You can visit your in-app settings for opt-out options.
3. Information Shared with Third Parties.
Except in the circumstances described in this Policy, we do not share, sell, rent, license, trade, or otherwise transfer or disclose your Personal Information with or to third parties for their promotional purposes. We may share de-identified, aggregated information without restriction.
3.1. Third-Party Service Providers.
We share information with our third-party service providers who assist us by performing services related to our operation of our Services (such as hosting, data storage, payment processing, and security) and to conduct marketing on our behalf. Some external service providers may also collect information directly from you (for example, a payment processor may request your billing and financial information) as a third-party service in accordance with their own privacy policy. Such external service providers do not share your financial information, like credit card number, with Wedgewell-McDuff, but may share limited information with us related to your purchase, like your zip or postal code.
3.2. Third-Party Analytics Services.
We may use third-party analytics services to assist us in better understanding users of our Services. For example, we use these services to track and analyze certain information, such as feature usage. We only ever provide these service providers with (or allow these service providers to collect on our behalf) the technical information described in Section 1.4. We use the information collected from these service providers to make our Services better and easier to use. The information we receive from these third parties may be re-associated with your Personal Information after we receive it back from these third parties.
3.3. Social Features.
When you use the Services, and in particular when you use our App, your use of social features within the app will share certain personal data with other players. This personal data includes your in-App profile (such as your username, your avatar, and your online status), your in-App actions and achievements, real-world locations associated with your use, or with App resources you interacted with when using the App.
3.4. Third-Party Advertising Partners.
Our Services include advertising for third party products and services. We and our partners use your information to improve advertising and targeting for third party ads that are shown in our App. This information is used to make sure that the ads that you see might be of interest to you or relevant to you.
This information may include ad identifiers and other non-personal information collected from your device, your interactions with our game and Services, including game play information, other information collected from third parties who have obtained your consent or have a legal right to share it with us.
Please note that if you opt-out of targeted advertisements on your device, you may still have advertisements in the App, but they will not be targeted advertisements (advertisements that are tailored to your interests by using your information).
Non-personal identifiers and other information collected from your device when you use our Services may be shared with advertising partners in order to deliver ads to your device. Such information may be combined with information that our advertising partners collect separately to serve you with more relevant ads (targeted ads) and to enhance the accuracy of their targeting.
We use ad identifiers that are non-permanent, non-personal identifiers such as the Android and/or Apple’s ID for advertising associated with your device, and similar technologies such as tracking pixels within ads to provide interest-based advertising. These technologies enable us and our third-party advertising partners to recognize you and your device and allow our Services to interact with a third-party social network or platform.
3.5. Merger or Reorganization.
We may transfer your Personal Information to another organization or entity if Wedgewell-McDuff is involved in a merger, acquisition, reorganization or other restructuring, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding in which information of our users are among the assets transferred. In this event, we will, if allowed, use reasonable efforts to notify you when your information is transferred to a third party (this notification may be made via email to you or by posting a prominent notice on the applicable website). Unless you consent otherwise, your Personal Information will remain subject to the promises made in this Privacy Policy, even after the transfer. But any information you provide after the transfer will likely be subject to a new privacy policy, and you should review that policy.
3.6. Required by Law. We reserve the right to release your information if we believe in good faith that (i) such release is required to comply with any law, rule, or regulation, or any search warrant, subpoena, court order, or similar legal process or (ii) disclosure is necessary to protect or enforce our rights or property, to protect the rights or property of others, to protect your safety or the safety of others, in emergency situations, to defend against legal claims, to enforce our contractual or other rights, or to take action regarding illegal activities or suspected fraud.
4. California Privacy Rights
4.1. This section applies only to California consumers whose personal information is subject to protection under the California Consumer Privacy Act (“CCPA”). It describes how we collect, use, and share California consumers’ Personal Information in our role as a business, and the rights applicable to such residents. The CCPA requires businesses to disclose whether they sell personal data. Wedgewell-McDuff is a business and does not sell personal data. We may share personal data with third parties if those third parties are authorized service providers or business partners who have agreed to our contractual limitations as to their retention, use, and disclosure of such personal data. If you are unable to access this Privacy Policy due to a disability or any physical or mental impairment, please contact us and we will arrange to supply you with the information you need in an alternative format that you can access. For purposes of this section, “Personal Information” has the meaning given in the CCPA.
4.2. How We Collect, Use, and Share your Personal Information. We have collected the following statutory categories of Personal Information in the past twelve (12) months:
a. Identifiers, such as first name, last name, and e-mail address. We collect this information directly from you or from single sign-on (SSO) identity providers (IDP) that you authorize. For example, if you access our Services through a third-party application, such as a social network or a third-party login service, we may collect information about you from that third party that you have made available via your privacy settings;
b. Geolocation data, such as IP address. We collect this information from your interaction with our web application;
c. Other personal information, in instances when you interact with us online, by email in the context of receiving help through our help desk or other support channels; participation in customer surveys or contests; or in providing the Services to you; and
d. California or federal law protected classification characteristics.
4.3. The business and commercial purposes for which we collect this information are described in Section 2 of this Privacy Policy. The categories of third parties to whom we “disclose” this information for a business purpose are described in Section 3 of this Privacy Policy.
4.4. You have certain rights regarding the Personal Information we collect or maintain about you. Please note these rights are not absolute, and there may be cases when we decline your request as permitted by law.
a. The right of access means that you have the right to request that we disclose to you or your authorized agent what Personal Information we have collected, used and disclosed about you in the past 12 months.
b. The right of deletion means that you have the right to request that we delete Personal Information collected or maintained by us, subject to certain exceptions.
c. The right to non-discrimination means that you will not receive any discriminatory treatment when you exercise one of your privacy rights.
4.5. How to Exercise your California Rights
You can exercise your rights yourself or you can alternatively designate an authorized agent to exercise these rights on your behalf. Please note that to protect your Personal Information, we will verify your identity by a method appropriate to the type of request you are making. We may also request that your authorized agent have written permission from you to make requests on your behalf, and we may also need to verify your authorized agent’s identity to protect your Personal Information.

5. Data Protection and Security.
We use commercially reasonable physical, technical, and administrative safeguards to preserve the integrity and security of all information we collect. However, we cannot ensure or warrant the security of any information you transmit to us or guarantee that information we collect may not be accessed, disclosed, altered, or destroyed.
We encrypt the transmission of Personal Information using secure socket layer technology (SSL). We follow generally accepted standards to protect the Personal Information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. 6. Choices about Your Personal Information.

7. Links to other Websites or Services.
We do not select, control, or authorize the use of any third-party products or services, including any websites, applications, or web-based services that are linked to or available through our Services. Users should always confirm that such third-party product or services have adequate privacy protection policies and practices before utilizing or authorizing their use.
8. Changes to Our Policy.
We may update or change this Privacy Policy from time to time and we encourage you to periodically review this page for the latest information on our privacy practices. If we are going to make significant changes in the way we use Personal Information, we will give you advance notice of at least 14 days.
9. Children’s Privacy.
We do not knowingly collect personally identifiable information from (or permit submission of such information by) anyone under age 18. If we learn that we have received personally identifiable information from a child under age 18 in violation of this Policy, we will delete that information from our files.
